Images, renderings, visualizations, and prototypes displayed on the Site are intended for illustrative purposes and may differ from final products.
Payment methods available for a particular order will be communicated during the quotation, invoicing, ordering, or checkout process. We may accept payment through bank transfer, electronic payment services, online payment processors, card payments, or other payment methods made available by Biomech Studio from time to time.

All payments shall be made in the currency specified on the relevant quotation, invoice, order confirmation, or checkout page.
We reserve the right to correct pricing errors, inaccuracies, or omissions prior to accepting an order. Failure to make payment may result in suspension, cancellation, withholding of deliverables, or termination of Services.
Due to the custom, personalized, and engineering-based nature of our services and products, orders may not be cancelled or refunded once design work, engineering development, CAD modeling, manufacturing preparation, production, or fulfillment has commenced.
Clients are encouraged to carefully review all project requirements, measurements, scans, specifications, and quotations before confirming an order. If a project has not yet entered the design, development, production, or fulfillment stage, Biomech Studio may, at its sole discretion, approve a partial or full refund.
Where an issue is determined to have resulted directly from an error by Biomech Studio, we will make reasonable efforts to correct, revise, repair, replace, or otherwise remedy the affected deliverable or product where appropriate.

Clients may submit scans, measurements, CAD references, design specifications, reviews, comments, images, documents, patient-related information, or other materials in connection with the Services ("Client Materials").

You remain responsible for the accuracy and legality of all Client Materials submitted to Biomech Studio.
Clients retain ownership of all scans, measurements, specifications, patient information, reference files, and other Client Materials provided to Biomech Studio.
By submitting Client Materials, you grant Biomech Studio a non-exclusive right to access, process, store, reproduce, modify, and use such materials solely for the purpose of: delivering requested services, product development, manufacturing preparation, quality assurance, technical support, and contract fulfillment.
We will handle Client Materials in accordance with our Privacy Policy and applicable data protection laws. Nothing in this section transfers ownership of Client Materials to Biomech Studio.
Where the Services permit reviews, testimonials, ratings, or feedback, users agree that:
Biomech Studio reserves the right, but not the obligation, to monitor, edit, refuse, remove, or disable any review at its sole discretion.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

WE DO NOT GUARANTEE THAT: THE SERVICES WILL BE ERROR-FREE; THE SERVICES WILL MEET EVERY USER'S REQUIREMENTS; THE SERVICES WILL OPERATE WITHOUT INTERRUPTION; OR ALL INFORMATION WILL ALWAYS BE ACCURATE OR COMPLETE.
FINAL PRODUCT PERFORMANCE MAY VARY DEPENDING ON MANUFACTURING METHODS, MATERIALS, PRACTITIONER MODIFICATIONS, PATIENT CONDITIONS, FOOTWEAR SELECTION, USER BEHAVIOR, AND OTHER FACTORS BEYOND THE CONTROL OF BIOMECH STUDIO. USE OF THE SERVICES IS AT YOUR SOLE RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, BIOMECH STUDIO LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
This includes, without limitation:
whether arising in contract, tort, negligence, strict liability, or otherwise.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIOMECH STUDIO'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY THE CLIENT FOR THE SPECIFIC PROJECT OR SERVICE GIVING RISE TO THE CLAIM.
Nothing in these Legal Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.
You agree to defend, indemnify, and hold harmless BIOMECH STUDIO LTD, its directors, officers, employees, contractors, affiliates, successors, and agents from and against any claims, liabilities, losses, damages, costs, expenses, or legal fees arising from:

Biomech Studio may maintain records, project files, communications, design files, technical data, and related information necessary for providing the Services.
While we implement reasonable safeguards and backup procedures, we do not guarantee against loss, corruption, or unavailability of data.
Clients remain responsible for maintaining their own copies of: scan files, CAD files, measurements, specifications, project documentation, and patient-related information.
Biomech Studio shall not be responsible for losses arising from failure to maintain independent backups.
Visiting the Site, communicating with us electronically, sending emails, uploading files, completing forms, or placing orders constitutes electronic communication. You consent to receive communications electronically from Biomech Studio.
You agree that electronic communications, agreements, notices, disclosures, invoices, approvals, authorizations, and records satisfy any legal requirement that such communications be provided in writing.
Electronic approvals, confirmations, and instructions provided by clients may be relied upon by Biomech Studio for project execution.
These Legal Terms, together with any policies, quotations, project agreements, statements of work, invoices, and other referenced documents, constitute the entire agreement between you and Biomech Studio regarding the Services.
If any provision of these Legal Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Failure by Biomech Studio to enforce any provision shall not constitute a waiver of that provision or any other right.
Biomech Studio may assign or transfer its rights and obligations under these Legal Terms without restriction. You may not assign your rights or obligations without our prior written consent.
Biomech Studio shall not be liable for delays or failures resulting from events beyond its reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, internet outages, cyber incidents, government actions, transportation disruptions, supplier failures, pandemics, or utility interruptions.
Clients, medical practitioners, manufacturers, clinicians, and other authorized parties are solely responsible for reviewing and approving all designs, dimensions, specifications, corrections, and project requirements before final delivery, production, manufacturing, or implementation.
Approval of a design constitutes confirmation that: measurements are correct, specifications are correct, design features are acceptable, and manufacturing requirements have been verified.
Biomech Studio shall not be liable for errors, defects, sizing issues, fit problems, production losses, patient discomfort, or other outcomes resulting from: approved designs, incorrect client instructions, incorrect measurements, incomplete project information, or manufacturing changes requested by the client.
Any modifications requested after final approval may incur additional fees. This section applies to both digital deliverables and physical products manufactured or supplied based on approved designs.
Biomech Studio acts solely as a provider of orthopedic CAD design, biomechanical engineering, digital development, prototyping, manufacturing support, and related services.
Biomech Studio does not provide: medical diagnoses, clinical treatment plans, medical prescriptions, physical examinations, or healthcare services.
Any orthotic device, shoe last, splint, insole, prototype, or related product should be reviewed and evaluated by appropriately qualified healthcare professionals where required. Clients and practitioners remain solely responsible for determining the suitability, safety, effectiveness, and clinical appropriateness of any design or product.
Biomech Studio disclaims responsibility for clinical outcomes, therapeutic effectiveness, patient treatment decisions, or healthcare-related decisions.
The fit and quality of the final 3D printed or designed product relies entirely on the precision and quality of the raw 3D scans, blueprints, or physical measurements uploaded by the client.
Clients are responsible for ensuring that all submitted: scans, measurements, blueprints, specifications, photographs, CAD references, STL files, OBJ files, or other technical data, are accurate, complete, and suitable for the intended purpose.
Biomech Studio shall not be responsible for inaccuracies, fit issues, production problems, or performance issues resulting from: inaccurate measurements, low-quality scans, corrupted files, incomplete information, data collection errors, or scan artifacts or distortions.
Clients retain ownership of all scans, measurements, specifications, patient information, reference files, and materials supplied to Biomech Studio.
Biomech Studio retains ownership of its proprietary: design methodologies, CAD workflows, engineering processes, templates, libraries, software tools, automation systems, know-how, and internal development resources.
Upon full payment, clients receive a perpetual, non-exclusive license to use the delivered files, designs, models, orthotic devices, shoe lasts, insoles, splints, prototypes, and related deliverables for their intended clinical, manufacturing, commercial, educational, research, or business purposes.
Unless otherwise agreed in writing or where confidential information is involved, Biomech Studio may retain copies of completed work for: internal record keeping, quality assurance, training, research and development, portfolio presentation, marketing purposes, or case-study purposes, provided that confidential information and personally identifiable patient information are not disclosed without appropriate authorization.
